Eugene T. Lee prompts NFLPA to enact amendments to NFLPA Contract Advisor Regulations and Standard Representation Agreement

New York, NY — The NFLPA recently enacted amendments to Section 4(B) of the NFLPA Regulations Governing Contract Advisors and Paragraph 4 of the Standard Representation Agreement (“SRA”). Both Section 4(B) of the Regulations and Paragraph 4 of the SRA define the term “compensation” as it relates to a Contract Advisor’s fee. The amendments to Section 4(B) and Paragraph 4, which were enacted on May 18, 2004, address Practice Squad salary negotiated in excess of the minimum Practice Squad salary specified in Article XXXIV of the NFL Collective Bargaining Agreement. The amendments were enacted after Eugene T. Lee, Esq. of ETL Associates, Inc. negotiated Practice Squad salary for one of his clients in October 2002 (Tyreo Harrison of the Philadelphia Eagles) at 53 man active/inactive roster minimum base salary — an amount in excess of the minimum Practice Squad salary by $9,235 per week. Four weeks later, when the Eagles re-signed Tyreo to the 53 man active/inactive roster, Tyreo had earned $36,940 more than what he would’ve earned if he were paid the minimum Practice Squad salary.

AMENDMENT TO SECTION 4(B) — NFLPA REGULATIONS GOVERNING CONTRACT ADVISORS

“(3) As used in this Section 4(B), the term ‘compensation’ shall be deemed to include only salaries, signing bonuses, reporting bonuses, roster bonuses, Practice Squad salary in excess of the minimum Practice Squad salary specified in the [sic] Article XXXIV of the Collective Bargaining Agreement, and any performance incentives earned by the player during the term of the contract (including any option year) negotiated by the Contract Advisor.”

AMENDMENT TO PARAGRAPH 4 — STANDARD REPRESENTATION AGREEMENT

“In computing the allowable fee pursuant to this Paragraph 4 the term ‘compensation’ shall include only base salaries, signing bonuses, reporting bonuses, roster bonuses, Practice Squad salary in excess of the minimum Practice Squad salary specified in Article XXXIV of the Collective Bargaining Agreement, and any performance incentives actually received by Player.”
